These Terms of Service ("Terms") govern access to and use of the website, mobile application and services provided by NOW ("we", "our", "us"). By creating an account, downloading the app or using our Services, you agree to be bound by these Terms.

In these Terms, the following words have the following meanings:
- "Services": all features offered by NOW through its website and mobile application.
- "User": any natural person using NOW to search for professionals, offers or services.
- "Professional": any merchant, independent worker or entity registered on NOW to publish offers and be visible to users.
- "Content": any information, text, image, video, review or data published on NOW.
2. Purpose of the Services
NOW connects users with nearby professionals through real-time geolocation. NOW acts as a technical intermediary and does not participate in transactions, contracts or services concluded directly between users and professionals.
3. Account creation and management
To access certain features, you must create an account. You agree to provide accurate, complete and up-to-date information and to keep your login credentials confidential. Any activity performed from your account is deemed to be performed by you.
In case of non-compliant use, false information or fraudulent behavior, we reserve the right to suspend or delete your account, temporarily or permanently, without notice or compensation.
4. Use of the Services
You agree to use NOW in compliance with the law, public morality and these Terms. In particular, it is prohibited to:
- impersonate another person;
- publish false, misleading, defamatory, offensive, discriminatory or illegal content;
- harass, threaten or harm others;
- circumvent security measures or interfere with the operation of NOW;
- collect personal data of other users without authorization;
- use NOW for unauthorized commercial purposes.
5. Content published by users and professionals
You remain the owner of the content you publish on NOW. By publishing it, you grant us a worldwide, non-exclusive, royalty-free license to use it for the purposes of the Services.
You warrant that your content does not infringe the rights of third parties, that it is accurate and lawful. We reserve the right to moderate, reject, hide or remove any non-compliant content.
6. Offers and commitments by professionals
Professionals are solely responsible for the information, offers, prices, availability and services they publish. NOW does not guarantee the accuracy, quality or availability of displayed offers.
Offers, promotions and professional information must be honest, clear and kept up to date. A professional who publishes an offer must be able to honor the corresponding commitments.
7. Geolocation
Geolocation is an essential feature of NOW. By using the app, you consent to the collection and use of your location in accordance with our Privacy Policy.
You can disable geolocation in your device settings. Some features may then be limited or unavailable.
8. Subscriptions and payments
Some Services, particularly for professionals, may be paid. Prices, billing terms and renewal conditions are shown in the app or on the website. By subscribing, you accept the current payment terms.
Subscriptions renew automatically unless cancelled before the renewal date. No refund will be given for the current period, except as required by law.
9. Intellectual property
All elements of NOW (trademarks, logos, graphics, text, software, etc.) are protected by intellectual property law. Any reproduction, modification or exploitation without prior written authorization is strictly prohibited.
10. Liability
NOW makes every effort to ensure the availability and security of the Services. However, we cannot be held liable for:
- content published by users or professionals;
- relationships, transactions or disputes between users and professionals;
- indirect damages, data loss or lost profits;
- temporary unavailability due to maintenance, failures or force majeure.
To the fullest extent permitted by law, our total liability is limited to the amount paid by the user for paid Services in the twelve months preceding the claim, or zero for free services.
11. Changes to the Services and Terms
We reserve the right to modify the Services or these Terms at any time. Changes are posted on the website or in the app. Continued use of the Services after such changes constitutes acceptance of the new Terms.
12. Termination
You can delete your account at any time from the app settings. We reserve the right to suspend or delete an account in case of violation of these Terms.
13. Governing law and disputes
These Terms are governed by Belgian law. In case of dispute, the parties will first attempt to reach an amicable solution. Failing that, the competent courts of Brussels, Belgium, will have exclusive jurisdiction.
